Right-of-Way is comprised of the following sections:
Administration: 402-479-4761
- Right-of-Way provides all Department real estate services.
Appraisal: 402-479-4478
- Creating and reviewing appraisals and valuation documents for all right-of-way needed to support construction and maintenance programs.
- Creating and reviewing appraisals and valuation documents needed for the disposal of excess real estate including access rights and also for Highway Beautification.
- Assisting the Department’s Legal Staff in making decisions regarding settlement, appeals, etc., on eminent domain cases and providing expert testimony as needed.
- Providing oversight of LPA prepared cost estimates, appraisals, waiver valuations and appraisal reviews for compliance with both Federal and State laws, rules, and regulations as applicable.
Highway Beautification: 402-479-4463
- Reviewing all applications for advertising signs, billboards and junkyards to determine if the applicant qualifies for a permit and issue said permit upon qualification.
- Working with owners of illegal signs and junkyards to take corrective measures to alter the deficiency so it is legal or to remove the sign or junkyards.
- Coordinating required legal action with the Attorney General’s staff for illegal signs and junkyards.
Property Management: 402-479-4770
- Preparing Right of Way Certificates.
- Managing, leasing and selling surplus land.
- Filing corridor protection plans and managing the corridor protection program.

Design: 402-479-3726
- Checking of right of way surveys to ensure compliance with appropriate standards, adequate coverage for project, and suitability of use.
- Creating projects in the Automated Right of Way Management System (ARMS).
- Determining ROW needs for projects.
- Designing and preparing right of way plans to identify property to be acquired for highway use.
- Developing legal descriptions to be used in instruments of conveyance.
Negotiations: 402-479-4488
- Preparing all documents needed to present the offers and close the transactions.
- Contacting all property owners and tenants to make the purchase offers and to inform the owners of their rights, duties and obligations.
- Processing all payments of any kind made by the Division.
Relocation & Local Assistance Section (LPA Projects and Oversite): 402-479-4484
- Preparing all documents needed to present the offers and close the transactions.
- Contacting all property owners and tenants to make the purchase offers and to inform the owners of their rights, duties and obligations.
- Preparing relocation assistance studies to determine eligibility for and amount of relocation assistance payments.
- Monitoring Local Public Agency’s right of way activities to ensure compliance with applicable Federal and State law and rules and regulations.
